PRESS RELEASE

I AM NOT A SLAVE!!

I intend to exercise my First Amendment Right of Free speech and freedom of assembly in front of the Catholic/Jesuit University of San Francisco at Parker and Fulton Streets on March 1st weather permitting,.

I will be filmed to document my protest and record any attempt by the Catholic/Jesuit University of San Francisco to intimidate me or otherwise coercive me. I invite all media to attend a press conference at that site on March 1st at 10 am when I will explain the larger implications of the economic injustice done to me by three billion dollar organizations: Merrill Lynch, the Catholic/Jesuit University of San Francisco and the Shriners Hospital Group.

In short they have perpetrated an Economic Lynching. Note the accompanying artist rendition of my anguish.

Because of the profound economic damage (I will soon be homeless living on the streets of San Francisco.) done to me. I will put my health and my life on the line in a Hunger Strike.

I worked 365/366 days, 24hrs a day for
six years and four months. This labor
was ruled worthless in the eyes of the
White racist Orange County Judge
James P. Gray. Thus, violating my 13th
Amendment Right against “involuntary
servitude and/or slavery.

I ask the people of San Francisco and the world at large to demand that the Catholic/Jesuit University of San Francisco and the Shriners Hospital Group pay their “FAIR SHARE” of the labor costs. They enjoy enjoyed a windfall of $700,000 at the expense of my slave labor. They never ask or investigated how that much money could have accrued. Their “greed and avarice” is so profound that they are perfectly willing to throw me out of my home, perpetrate a scorched earth policy that has resulted in the near absolute destruction of my ability to be an independent tax-paying citizen. And their actions will force me to live on the streets of San Francisco that the age of 70.

They have immorally and unethically used the full force of their power and money to bring about the economic destruction of a simple law abiding, veteran of the Cold War, who served honorably in the surrounded enclave of West Berlin, I’ve harmed no one, I don’t even have a parking ticket.

To you the media, for the sake of the 30,000,000 American families that will face this sort of situation in the coming decades, this is your opportunity to forge a public policy that will make it possible for Family Caregivers to have a life after caregiving in obedience to the Fourth Commandant: Honor Thy Father and Thy Mother.

You need to investigate the busy work of lobbyists who create unconstitutional codes detrimental the “average person on the street”. at Parker and Fulton Streets in of Help me shine a light on this atrocity.


PRESS RELEASE : DAY FIFTY EIGHT

Today is 4/27/2004 the 58th day of my hunger strike. Tomorrow, 4/28/2004, I am ending my Hunger Strike. The primary reason is 51.50 which effectively creates a police state in which the helpless little man cannot aS one person in America make a forceful peaceful protest that should have meaning to any man of good will who calls himself humane and a freedom loving Republican (and I don’t mean in the sense of today’s American Political Republican Party member) but in the sense of the old Roman Republicans betrayed by Julius Ceasar who with the power of a military he owned swept away centuries of democratic populous governance to establish an Imperial monarchic Rome which did not last. I fear since our media who should have been what the Founding Father’s referred to as the Fourth Estate, an unofficial branch of government has now been usurped and commandeered by the corporate oligarchy and is effectively muzzled so that it no longer does investigative reporting which can get ahead of the curve on issues of importance to the little people. I am warning the media that the Kazinski’s and McViegh’s of the world might have been tempered with a moments attention from you. Would Kazinski have reeked his havoc if someone had published his Manifesto however idiotic it might seem to the so-called sophisticates in the media whose snobbish arrogant self-congratulating hubris is exposed in the likes of reporters, now exposed to be liars and plagiarists who at some level were known to be so by editors and people otherwise charged with oversight. The only thing that keeps the public safe from my wrath against the Catholic Leadership the Shriners and Merrill Lynch is that my mother did NOT raise a murderer. It's definetly NOT being a coward to back out of the situation T.  It's not like there are 20 or 30 of you with great publicity...  you'd had to do this ALL ON YOUR OWN and I for one am so incredibly proud of what you've done and put yourself through.  It shows enormous courage and character.  So starting to pull back and ease out of the situation is NOT being a coward it's knowing when enough is enough and you've done your absolute and utter best in such a horrendous situation.  If you need to last a few more weeks then definitely do what I suggested ... start to nourish the body with vege soup or puree fruit... start to get the vitamins and nutrients back into the body... just enough to keep you going for the next few weeks until the speeches are over..   But if you'd rather back out now then that is totally ok T - there is nothing wrong with doing that - if you've had enough and feel that a few more weeks is just too much to go through then pulling out is the thing to do.  There is zero cowardness about it so don't even think like that!!!

Today is 4/26/2004 the 57th day of my hunger strike. Tomorrow, Monday, I will be at the City Hall on the Plaza side. On Tuesday I will stand down to prepare for my speech in front of the Board of Supervisors. Wednesday I will canvas the Board of Supervisors for a meeting. On weekends I’ll be in front St. Ignatius at Parker and Fulton.

Daily diary: Well, it happened again. I was engaged in a conversation with a guy who doesn’t believe I have gone without solid food for 57 days. In the conversation, I discovered he had an ability to understand fact though, I had already turned off and was ready to just listen and let him rundown and walk away. But when I began to point out that anorexics live years depriving themselves of food. Then he said an odd thing, ‘you can’t advertise this number, people are going to be jealous of your power of will, I am jealous of you.’ It turned out he was a faster and a follower of some mysticism system that required fasting of some sort. He was looking for some animal need or craving in my eyes. Weird. At least to me. I can prove I have been doing something to lose 45 lbs in 57 days. It can’t be done any other way than to not eat solid food. That is the reason dieting is so difficult. Carbohydrates alone converts to fat. Calories equal fat. Subway sandwiches are supposed to bring a person down to the weight they should be but not in 57 days. The time factor is the telling thing. But, my accuser turned suddenly into an advisor for my amateurish approach to my signs. He may be right. I’m looking at his advice. What I am doing now isn’t particularly working or is it? One really never knows the effect one has on the public as they stop to read my signs.

The Board of Supervisors Speech #2.

My name is Tito Abao. I am on day 58 of my hunger strike. I have lost 45lbs. I asked you last week to be the ‘honest broker’ and to consider implementing a ‘Caregivers Bill of Rights’ for family member caregivers of San Francisco. San Francisco started the effort to give human rights to gays and lesbians by marrying couples in a public demonstration of human decency. Now it is time once again for San Francisco to take the lead in protecting Family Member Caregivers. This week I would like to bring to your attention the actions of Merrill Lynch, a financial institution I retained to manage my mother’s trust. As their direct client, I had a reasonable expectation they would represent my family’s interests and my mother’s wishes. Instead, they chose to violate those interests. With the opportunity for future profit presented by the University of San Francisco and the Shriners Hospital. Merrill Lynch chose to side with the money and to defraud their own client. They obtained a change of venue from San Francisco, the home of all the principals in the case, to Orange County, probably the most racist and classist county in California. As the principal bond writer for Orange County, Merrill Lynch had undue influence in that county. We need to work together to identify how companies like Merrill Lynch can be made responsible to their clients and can be mandated to ethical conduct. San Francisco has to stand shoulder to shoulder with Eliot Spitzer of New York State and gain control and oversight over predator multinationals like Merrill Lynch, Catholic Jesuit University of San Francisco and Shriners Hospital. I might add my mother and father’s 14th Amendment Rights and my own 13th Amendment rights were trampled on, solely because they had the power of position and authority to do so, and because they calculated I could not adequately fight back. I ask this body to demonstrate that theirs was a miscalculation.

Daily diary: A dark apparition came peddling up the sidewalk toward me. At first, I could not figure out what it was exactly. As it neared me I saw a toothless African-American man considerably overdressed for a bicycle. He wore a huge black helmet with a clear plastic visor up. Black aviator headphones a small pair of Radio Shack Walkman headphones. On one leg was a black patent leather high-boot on the other a form fitting blue jean contrasted. He wore a tan swade cowboy jacket with the usual tassles. He nodded his head as he passed me. Stepping off his bike in front of the Carmelite chapel he seemed to praise heaven waving his hands toward God. He then disappeared inside the church. Shortly, he came out and cycled up to me and asked if I could spare some change. I shook my head no. As he passed he seemed to realize I had a sign that said, ‘Hunger Strike’. He seemed startled. Then came back saying, ‘Man, no wonder you don’t have any money…youse honngrry…and searches around in his pocket and comes up with 51 cents and hands it to me saying, ‘here go get a hamburger.’ Then he rides off mumbling, ‘Hunger strike, hunger strike,’ as he faded in the distance. I fell into the trap of a Latin woman who had a preconceived notion about my situation. I got into a heated conversation with her, two excitable characters getting excited. When she left I realized I tried to explain a complex thing to someone who had no intention of understanding it. I was kicking myself and promised I would never do it again, yet again. Soon an Irish lady stopped and engaged me. I wasn’t going to explain it. But, people are insistent. I relented and to my amazement she was on my side. She also understood the savagery of the Catholic clergy. Now, an Ohio priest is arrested for a 15 year old murder of a nun. She offered me a hint about finding a job and walked off telling me don’t work for less than $10 and hour.

My name is Tito Abao. For 6 years I was the sole Caregiver to my mother 24/7. I quit my job and deferred my wages until after her death. I did this to insure there would be sufficient money to care for her for one year or twenty. Not taking a wage is the primary reason the Trust nearly doubled during those years. I did not do this without a labor agreement with my mother. When she died the remainder beneficiaries of her trust refused to honor my mother’s wishes. The Merrill Lynch Trust Company conspired with Southern California Judges, the University of San Francisco and the Shriners Hospital Group to deny me all compensation. The refusal of USF and the Shriners to negotiate demonstrated an inexplicable greed and avarice. I the 80-pound weakling spent nearly five years in court facing eight hundred pound legal gorillas and now I am nearly bankrupt, in danger of becoming one of the homeless solely and only because I cared for my mother thus adding to the current intrac-table homeless problem our city is now facing for no good reason. I need someone here to call USF and/or the Shriners and ask them to meet with me and negotiate a settlement to prevent my impending homelessness.These billion dollar organizations cannot be allowed to shirk their moral and ethical responsibility to not be a party to creating homelessness and thus becoming a part of the problem of homelessness. Nay, they have need to be held to a high standard of behavior in which they are involved in the solution of the homeless problem. This one was a no brainer. I have been on a hunger strike now for 49 days ave lost 42lbs. I am not on this Hunger Strike for myself alone what happened to me will happen to as many as 3,000,000 Americans across the country as long as the rights of family member caregivers are not established. What is needed is A Caregivers Bill of Rights and I would be happy to speak with anyone here about why this is needed and how it should be con-stituted. I have here a draft of just such a Caregivers Bill of Rights for your review. Daily diary: My obsession with my Complaint to the Commission on Judicial Performance is weighing heavily on my mind and psychology. I wanted to get it done very badly. I just had to go back home and work on finishing it. I was just too close to done not to get antsy enough to be jumping around like the old time Mexican jumping bean. Is that thing still around I wonder? I arrived at the site and got so anxious about being so close to done that I couldn’t stay on the corner and I raced home to finish it. I did just that! I finally finished the six-page treatment. Now, it goes to the refining process by my political advisor. Then to a lawyer person I know who will then whip it into shape for sending to the Commission. My goal is to build probable cause as to “Improper Influence” by Judges O’Leary, Comerford (both Catholic AND Jesuit) and of course Wiley who is a Christ Church member. My court judges were in the same position as the Salem witch-hunt jurist. A vested interest and violation of my right to the separation of Church and state doctrine that should remove religious affiliation from power over our governing process. With advocates like these in place in the proper positions of power they can enrich themselves through the power and influence of political and judicial backdoor shenani-gans. And three of them did just that believing I was too much of an insignificant “nigger bastard” who no predominantly white oversight entities would step up to the plate and defend. The predominantly white San Francisco Board of Supervisors sit in mute testimony of that indifference, my own elected representatives (?), no less. The predominantly white media and its abject fear of the Catholic Church or any entity of power that their corporate masters deem too important to profits. Remember Tisch and 60 Minutes…we pretend that the thing just got broke…but I suggest it was always broken. Even Bill O’Reilly the no spin man?? Was Al Franken right about O’Reilly?

Daily diary: The Complaint to the Commission on Judicial Performance is taking a tremendous amount of concentration. Plus, my next three minutes speech on Tuesday 4/27 is taking a lot of practice. I’m trying to get rid of the stumbles. I’ve arranged to have my cameraman come and film the proceedings. I’m beginning to see a documentary developing here in the style of Michael Moore. Film a real life event in the daily life of an ordinary American struggling to prevent himself from being made homeless by the Catholic/Jesuit University of San Francisco and the Shriners Hospital Group. How the Mayor’s Office has no desire to take just the most humane steps to prevent my impending homelessness. How the Board of Supervisors is taking the same stand. Even Pier-Alioto whose avowed job it is to do something about homelessness refuses to help me setup some kind of back channel pathway to the Catholic/Jesuit University of San Francisco and the Shriners Hospital Group to help prevent my impending homelessness. How the media steadfastly ignores a now 54 day hunger strike. If I was white they would be there. But they the media don’t want any part of a non-violent nigger. The media wants a nigger who murders people like the African-American shooter of the undercover police officer in Bay View. Their disgraceful motto is ‘if it bleeds it leads.’ The media’s bread and butter is doing vacuous and innocuous stuff about following around the unfortunates after they have become derelicts. Another media motto is ‘if it’s sad we’re glad.’ But please don’t ask us to expose the ugly under belly of Uncharitable Charities and the savagery of the Catholic Leadership. Now, the Vatican is using a (female I withhold sex) weapon against Catholic politicians by deciding to withhold communion to anyone who doesn’t vote the way the Vatican wants and there is not a peep of outrage against the Vatican by the American media that the Catholic Church seeks to rule our country by extorting our politicians.

Today is 4/22/2004 the 53th day of my hunger strike. To keep in touch with the people at the Corner of Parker and Fulton in front St. Ignatius I will stand there Friday 4/23 and the weekend.

Daily diary: Today I set to work on my Complaint to the Commission on Judicial Performance as well as making sure my speech for the coming Tuesday Supervisors meeting was 2 minutes long. The complaint is a real tour de force people on the street don’t know what it really takes to get the attention of these oversight bodies. I believe they are essentially quite bogus as is everything else about our culture. When you step up to the plate you discover that the truth is that these things are designed to pretend that you have rights, but unless a judge stands up in court whips down his or her pants or panties and farts in the face of the assembled audience. These watchdog groups will do nothing. So in the end the watchdog groups turn out to be lapdog groups pulling down a paycheck. The only saving grace is that eventually you can get a judge (maybe?!) to order an investigation. I realize how true this all was at the Supervisors meeting when they voted to seat people on the Police Board of Inquiry. One candidate was particularly regarded by some as in the pocket of the Police Union and has never done his job of legitimate oversight, but, because he was Chinese the Supervisors by majority vote seated him. My case is a clear conflict of interest on the part of Judges Kathleen O’Leary and Eileen Comerford both Catholic and Jesuit trained. Supreme Court Justice Antonin Scalia clearly writes in his 21 page memo that a judge must recuse themselves from any case that redounds to the financial gain of their intimate connections. So looks like business as usual for the San Francisco police department. All I can do is fight on. Next is my Writ of Certiorae.

Today is 4/21/2004 the 52th day of my hunger strike. Due to a Green Party Meeting last night that ran late I will not be on the street tomorrow Thursday 4/22. To keep in touch with the people at the Corner of Parker and Fulton in front St. Ignatius I will stand there Friday 4/23 and the weekend.

Daily diary: Today I have now matched Susan Moloney’s 52 day hunger strike for the old growth in Sacramento. The next milestone is Tim Ream of Oregon who went 75 days in Eugene, Oregon. I got the run around by the receptionists and aides of the Supervisors, as I wended my way through their offices. Sandoval is pre-occupied with budgetary concerns and talks to no one except on that issue. I encountered Sophie Maxwell the African-American supervisor, she talked to at least three people as I approached her. But suddenly she had to go to a meeting and couldn’t spare me a moment. I know that they all recognize me from my forceful speech and are running for cover. My speech had an effect on the Sheriff deputies because a couple congratulated me on my presentation. Ammiano’s aide even said explicitly that he heard my speech with something of an emphatic, ‘You go nowhere in this office glare.’ He said, “We don’t do Trusts!” Or did he mean we don’t protect the public from the Catholic Church because they get out votes. But didn’t Ammiano the openly gay supervisor step into forbidden territory with his advocacy of the Gay and Lesbian community? How were these issues outside the realm of the Board of Supervisors to act? I remember the Board of Supervisors actually doing foreign policy to the chagrin of national politicians who complained that was none of any City Official’s business. So they can get involved in anything they really want to get involved in if they so desire. And what of the fixers who pick up telephones and back channel deals or favors. A friend of the people statement to the press on my issue would do wonders to put a spotlight on it, if nothing else. It is clear that these elected City Officials do not want to prevent homelessness. My impending homelessness is easy to stop. I see that they need the homeless to get money from the State and the Fed. Pier-Alioto astounded me with the announcement of a $20,000,00 grant from the Fed for the homeless issue to create their concentration camp, excuse me, the Care Not Cash program. The more homeless the merrier for the bureaucrats to wring their hands with glee as they spend, spend, spend building niche empires fed by more and more dollars to do what? To make sure there is always more than enough homelessness to justify a crackdown. But, that crackdown always takes money, money, and more money. Tax dollars on top of tax dollars. We in San Francisco have a $350,000,000 deficit. A city income tax is contemplated. While top rung city officials make a base salary of $250,000 a year, not counting all the perks and side benefits. The rumor is ‘Joe Six pack’ city workers are now going on the chopping block, but I hear no rumbling of cuts in the salaries and benefits in the upper ranks. Yet they will not lift a finger to keep me as a taxpaying entity. They would rather have me as a welfare leach and protect the Catholic Jesuit University of San Francisco and the Shriners Hospital Group who pay no taxes and in fact siphon tax dollars out of the system. Rep Nancy Pelosi, leader of the House, worth $90,000,000 personally gave USF $1,000,000 out of the Pork Barrel a gift from the American taxpayer. It is all one great farce. The Kingdom of the nobles and serfs is alive and well. The feudal social order is in tact!

The Reason I’m on a Hunger Strike

There is a larger goal to my ‘Hunger Strike’. My case besides being a gross violation of my 13th Amendment right against being sold into slavery by any government entity is also a gross violation of my mother and my father’s 14th Amendment right to dispense with their own property in any manner they deemed appropriate, without interference from the state. Today is 4/19/2004 the 50th day of my hunger strike. Today I will deliver my speech text and my ‘Caregiver’s Bill of Rights’ document to each Supervisor and attempt do a one on one interview. The plan is to be weekdays at City Hall; weekends at St. Ignatius at Parker and Fulton.

Daily diary: The speech went fine. They have cut the time to 2 minutes soon they will provide no time. I stumbled in a couple of places. But, delivered with force. I don’t know how to exit with grace and elegance as of yet. As The Terminator said, ‘I’ll be baaaaaaaaaack!’

THE CAREGIVERS BILL OF RIGHTS

  1. Above all things the Prudent man rule must sit as a foundation upon which all judicial discretion hinges, if we ALLOW judicial discretion.
  2. The court must mitigate expenses of the poorest litigant.
  3. The court must ensure that no beneficiaries who did not participate in the care of the parent, is unjustly enriched by another’s labors.
  4. No Professional Trustee may control venue: a. The power and influence of a Professional Trustee must be considered in the venue. b. The case must be heard in the jurisdiction where the Will was drawn and where the principles involved in the CAREGIVING resides.
  5. Any estate valued under $5,000,000 that comes under a caregiver dispute must be arbitrated. This will ensure a fair settlement without the ruinous need for exorbitant legal expenses which can ruin the future of the senior citizen caregivers who depend on the inheritance for their future economic well being, as well as, expedite the proceedings.
  6. The arbitration shall be conducted without lawyers, there are to be at least three arbitration experts and their credentials shall be in labor issues, social service areas and be of good standing in the community. The burden of proof shall be on the claimants against the caregiver and their burden shall be to prove that the service was not rendered or rendered incompetently.
  7. The Caregiver shall be compensated at the average of the prevailing wage for an equal service that is normal in the community or at the Caregiver’s discretion receive the compensation he/she is willing to accept whichever is the lesser.
  8. No entity may impound or otherwise hinder the distribution of Willed assets in which the Caregiver is named beneficiary. (We don’t want a 70 year old individual in court waiting for money for three to five years.)
  9. Charities and Non-profits named in Wills and Trusts may not sue or otherwise use the judiciary to resolve disputes with a Primary Caregiver. They must submit their claims to an arbitration board, who will rule according to the Prudent man rule, equity, fairness, mercy and availability of funds, they may not make destitute any Caregiver (defined as a family member).

I am interested in sending you a detailed proposal for Uncharitable Charities…A Self Protection Manual, a non-fiction work that details my own experience with the legal tactics employed by remainder beneficiaries of trusts and wills to suborn the intent of the deceased, while providing strategies for self-protection which will be necessary tools for as many as three million Americans in the next decade as Baby Boomers (A Baby Boomer will reach age 50 every 7-1/2 seconds (WSJ – 1/20/96) until 2006.) and subsequent generations (Gen – X’ers) become caregivers for their aging parents. These three million are the intended audience of this article or news magazine segment. The remainder trust is a standardized instrument with many variations that is employed to provide for the needs of a surviving spouse while alive, with the remainder of the unspent trust going to a charitable institution of choice. What happened to me and will happen to millions of other Americans is that when the surviving spouse themselves need continuous care, their children, not wishing to send the parent into the neglect of nursing homes, become caregivers. This involves emotional, physical, and financial commitments, which children undertake out of love for their parents; and, there is generally some semi-formal agreement between parent and child to recompense the financial expenditures through the medium of the Trust. In my own case this was a written agreement with my mother that I would be compensated at a rate not less than minimum wage for the years I spent caring for her, a compensation I chose to defer until after her death in order to preserve her Trust against the ravages of future medical bills and the real possibility that I would need to provide care for her for twenty years or more. It was our perception that, as my mother put it, “these are honorable people”. At the time it did seem like the Catholic University of San Francisco and the Shriners Hospital Group were indeed honorable. The subsequent revelations of sexual abuse had not yet surfaced.

The tactics deployed to repudiate my mother’s wishes that may yet result in the loss of my home form a significant part of the dissertation and are generalizable to a variety of bequest scenarios. Recognizing them and preventing their use through proper preparation of Wills and Trusts is a major part of the self-help as well as how-to side of this high concept. My story itself is the human interest, personal component. Sidebars include estate management and again my experience there, which literally doubled the size of my mothers Trust before her death, as well as legislative proposals, available resources, and more.

I have already written and self-published a book, Caregivers under Siege, which contains most of this material in a less-structured and polished form. My intention is to rewrite the whole manuscript under the guidance of your editorial consultation to provide greater accessibility while preserving the personal, anecdotal component. Daily diary: Weather very unsettled as the forecast predicted. Up ‘til now the rain has been lots of places except in San Francisco. About 8am I saw the rain clouds rolling in but they had been rolling over us without dumping. After a while light drizzle began I raced to save my books. Just in time, I thought but suddenly as I was driving home it all stopped. April is the month in California Al Jolson made famous with, ‘April Showers’. ‘When April showers they come your way. They bring the flowers that bloom in May…etc.’ since I am now very interested in the weather. I notice a distinct difference that I can relate to past experience. In April there are no strong down pours, it is always light drizzle. My ‘teched’ friend is not so ‘teched’ after all now that he established that he could beat me out of money he wants more. He looked at me with sad puppy dog eyes asking, ‘can you help me out again today?’ I replied, ‘do you read my signs? I’m out here to try to prevent going bankrupt man!’ He backs off, ‘yeah, yeah sorry.’ I guess I’m stuck with him as a constant irritant. Got lots done administratively. Honed my speech to the Board of Supervisors. Just hope I don’t stumble too much. Starting to rundown a bit. It is discouraging to feel like I am banging my head against a brick wall on the one hand. On the other being pro-active is a real moral enhancer in spite of it all. I am not laying down and allowing myself to be kicked to death by institutional corporate bullies bent on maintaining a serf population. The Catholic leadership are clearly ‘money changers in the temple’ with no principles and no morals. I feel they will continue to hide their perverts as long as Pope John Paul II is in the Vatican. His pedophile friend and advisor will see to that. The perverts are penetrated to the very top of the Catholic Church and only a new Pope may come in clean.

The Board of Supervisors Speech.

My name is Tito Abao. For 6 years I was the sole Caregiver to my mother 24/7. I quit my job and deferred my wages until after her death. I did this to insure there would be sufficient money to care for her for one year or twenty. Not taking a wage is the primary reason the Trust nearly doubled during those years. I did not do this without a labor agreement with my mother. When she died the remainder beneficiaries of her trust refused to honor my mother’s wishes. The Merrill Lynch Trust Company conspired with Southern California Judges, the University of San Francisco and the Shriners Hospital Group to deny me all compensation. The refusal of USF and the Shriners to negotiate demonstrated an inexplicable greed and avarice. I the 80-pound weakling spent nearly five years in court facing eight hundred pound legal gorillas and now I am nearly bankrupt, in danger of becoming one of the homeless solely and only because I cared for my mother thus adding to the current intrac-table homeless problem our city is now facing for no good reason. I need someone here to call USF and/or the Shriners and ask them to meet with me and negotiate a settlement to prevent my impending homelessness.These billion dollar organizations cannot be allowed to shirk their moral and ethical responsibility to not be a party to creating homelessness and thus becoming a part of the problem of homelessness. Nay, they have need to be held to a high standard of behavior in which they are involved in the solution of the homeless problem. This one was a no brainer. I have been on a hunger strike now for 49 days ave lost 42lbs. I am not on this Hunger Strike for myself alone what happened to me will happen to as many as 3,000,000 Americans across the country as long as the rights of family member caregivers are not established. What is needed is A Caregivers Bill of Rights and I would be happy to speak with anyone here about why this is needed and how it should be con-stituted. I have here a draft of just such a Caregivers Bill of Rights for your review. Riverside Estates Scandal Prompts Charges Against Ex-Judge

Retired Riverside Superior Court Judge William H. Sullivan was charged with misconduct yesterday by the Commission on Judicial Performance for questionable financial dealings with two trusts that continued after his appointment to the bench.

The charges against Sullivan, 73, are the latest fallout from Riverside County’s conservatorship scandal, in which a professional conservator and her attorney drew long prison sentences for using their positions to steal more than $1 million from people whose property they were supposed to be protecting.

The revelations of the thefts prompted county supervisors to question the relationship between the conservator and three deputy public defenders assigned to represent the interests of more than 1,000 conservatees. Then-Public Defender Margaret Spencer was fired after she defended the three and refused to place them on administrative leave.

Spencer’s wrongful-termination suit was thrown out on a summary judgment motion.

The CJP yesterday accused Sullivan, who presided over the county’s probate court during the period and was a longtime probate and estates lawyer in Riverside before his appointment, with:

•Violating conflict of interest rules by continuing to serve as a trustee for a local resident’s living trust after his appointment to the bench, making unsecured loans to himself from the trust, purchasing assets for the trust from other entities in which he had an interest; and using trust assets to acquire property in his own name and then failing to account to the trust for the appreciation in value;

•Presiding over a probate estate worth more than $1 million, despite the fact he had witnessed the will and handled the deceased’s financial affairs before her death and had been given power in the will to appoint a successor trustee; selling to the estate certain notes which he had purchased at a discount, pocketing the appreciation; retaining for himself the interest on payments made on the notes, approving an accounting that did not disclose his interest in the notes, and collecting annual trustee fees;

•Purchasing a conservatee’s home while presiding over the conservatorship advancing on his own motion the date of a court hearing on the sale, thus depriving disinterested parties from an opportunity to bid; and confirming the sale of the property to himself; and

•Violating Government Code ethics provisions by failing to disclose fees he received as a trustee, loans from the trusts, and interests in numerous real properties in Riverside County.

Sullivan’s attorney, Edward P. George of Long Beach, declined to comment on the specific charges. He said that Sullivan was “not a well person,” having had a series of strokes. He added that “everybody I’ve ever talked to [from Riverside County] has spoken of him as a highly respected bench officer.”

That view wasn’t shared by Barbara Jagiello, a San Francisco attorney who investigated Bonnie Cambalik and her company, West Coast Conservatorships, at the behest of a nonprofit organization that helps senior citizens. She expanded her investigation to include the judge’s conduct and filed a lengthy complaint with the CJP.

“I’m happy the commission kept up with” the investigation after Sullivan retired, Jagiello told the MetNews.

Normally, she explained, when an outsider discovers problems with conservators, the matter can be rectified simply by bringing it to the intention of the judge. It became clear that “something [was] rotten in Denmark,” she said, because Sullivan continually refused to hold Cambalik to account for blatant improprieties.

Cambalik is serving a 26-year prison term after pleading guilty to a total of 22 counts of embezzlement by a caretaker, grand theft, perjury and receiving stolen property. Attorney Michael Molloy was convicted of similar charges and sentenced to 16 years, and resigned from the State Bar with disciplinary charges pending.

Sullivan practiced law in Riverside from 1956 until his appointment to the bench by then-Gov. George Deukmejian in 1987. He retired in December 1999, several months after Cambalik confessed to looting estates.

Sullivan briefly returned to judicial office at the beginning of this year, having been named chief justice of the High Court of the Republic of the Marshall Islands. He resigned that post three weeks into his term of office, however, reportedly after officials there learned of Jagiello’s complaint to the CJP.

An Open Letter to the American People:

Over the next few years, millions of you reading this will be faced with the same challenges and legal battles I have been facing and fighting these last some 10 years. Facing the difficult challenge of providing loving caregiving to a parent who can no longer physically take care of themselves. Fighting cutthroat, greedy charities and trust management companies, both unwilling to embrace compassion, common sense, ethics and justice.

My story is not unlike millions of others throughout America. An adult child choosing to provide full-time caregiving for an elderly parent, rather than place them in an expensive, impersonal and sometimes cruel nursing (see www.apeape.org horror stories) facilities.

This letter must serve as a wake-up call to all Americans that our justice system, our probate laws and greedy charities are subjugating the American ideal that our elderly parents’ final wishes take a back seat to legal loopholes, back-door politics and outright criminal behavior.

OUR CURRENT PROBATE LAWS AND RAMPANT CORRUPTION IN THE JUDICIAL COLONY CAN SPELL FINANCIAL RUIN FOR YOU AND YOUR FAMILY!

Note: If you are in the lower middle class, as I am or was…(I now almost qualify for poverty status) it could mean the difference between losing your home and having to live on the streets. I am at this moment close to living on the streets. Time and my life savings are running out. If we don’t do something about this now, a cruel and grim future awaits the family caregiver…. Criminal behavior: I charge that:

Elliot Spitzer, Attorney General for New York shows that Merrill Lynch behaves like an ongoing criminal enterprise!!

I charge that in my case they perpetrated a fraud upon the court. Unfortunately, the court was all too willing to be defrauded. I can prove beyond a shadow of a doubt and to a moral certainty that they did so.

Fraudulent Jurists:

My investigation of Judges Kathleen O’Leary and Eileen Comerford (ruling in my case) are both Catholics ruling on a case involving a Catholic Institution. They both went to Jesuit institutions for their Law degrees. And they were ruling on a Catholic/Jesuit Institution. Neither informed my lawyer they had these potential conflicts of interest. Nor did they recuse themselves from the case. The appearance of impropriety is astonishingly profound. I would be willing to bet that one or more of these Irish Catholic individuals has a priest in their family. If they are Jesuit priests then this is the most savage and inexcusable abuse of power by human beings we entrust to rule fairly in the cases that come before them.

(Note: A recent ruling by a judicial internal oversight board, warn judges who were in any way connected with the Boy Scouts to recuse themselves from these cases.)

Uncharitable Charities:

The Catholic/Jesuit University of California and the Shriner’s Hospital Group, both “remainder beneficiaries” of my father’s Trust were driven by greed in their relentless quest for my father’s charitable bequest knowing with out “slave” labor on my part which was meant to preserve my mother’s resources of the whole of her life, could not have reached $700,000. Their greed is so profound that they are perfectly willing to see me driven out of my house and on to the street, just because I obeyed the Fifth Commandment: Honour thy father and thy mother…..

Note: The Pope recently called for fairness in dealing with “sexual predator priests”. Apparently, one deals fairly with criminals and use brutal unfairness with those of us who do our best to be good citizens and good children. Interesting set of values???

The Solutions:

If you are as outraged as I am and want to participate in an effort to guarantee protection of the rights of the Family to protect its right to determine its economic destiny in the matter of caring for its own and not be driven into poverty because of it voice your opinion in each of the following cases to the appropriate designated authority.

Contact the California State’s Attorney General’s office demand an investigation to determine whether The Merrill Lynch Trust Management Company intentionally misled The Orange County court.

Contact the United States Justice Department and demand the establishment of an independent prosecutor to investigate possible corruption in the Orange County Judicial system. A few years ago they uncovered a conservator ship ring involve a judge, who was allowed to retire without prosecution. Nine conservators went to jail. I think the ring was not completely exposed. Are Judges James P. Gray, Kathleen O’Leary, Eileen Comerford and William Wiley Bedsworth part of the unfinished business of corrupt Judges ruling on Probate cases and Conservator Ships…… demand a Federal Investigation!!!

The conflict of interest is profound and I can prove that this conflict of interest led them to revive “Jim Crow”. Judge James P. Gray revived “Dred Scott” and “Judges Kathleen O’Leary, Eileen Comerford and William Wiley Bedsworth revived “Jim Crow”. Demand an investigation into whether either Judges Kathleen O’Leary or Eileen Comerford, (both Irish Catholics) have priests in their close family and whether any of those priest relatives are JESUIT??!!
